As of 1 June 2013, any owner wishing to sell or rent out their property must present the Energy Certificate in accordance with Royal Decree 235/2013 of 5 April. Here are the most important questions in this context:
What is the Energy Certificate?
It is a document that describes the energy efficiency status of a building or part of it (dwelling, premises, office, etc.) and recommends improvements. It must be officially registered with the competent authority of the Autonomous Region.
Who is obliged to have the certificate?
All owners or developers who want to sell or rent their property. In addition, both the owner and the developer (or their advisor, with appropriate authorisation) are responsible for registering the certificate with the competent authority. All persons, companies and real estate agencies are obliged to indicate the existence of the certificate when advertising the property.
From when is it mandatory to have the Energy Certificate?
As of 1 June 2013, the certificate must be handed over or presented to the buyer or tenant.
Period of validity of the certificate?
The certificate is valid for 10 years from the date of issue. The owner is responsible for renewing the certificate with the competent authority after the expiry date, in accordance with the requirements.
What does the certificate cost?
The costs depend on the size of the property. We have quotes from different architects.
Sanctions for non-compliance?
The legislator imposes three types of sanctions:
1.- For minor violations: 300 to 600€.
2. for serious infringements: 601 to 1000€
3. for very serious infringements: 1001 to more than 6000€
Which properties are not affected by this?
-Detached properties with less than 50 m²
-New buildings from 2008 onwards
Who is authorised to issue the certificate?
The following persons are entitled to issue the certificate:
-Building technicians and engineers
These persons must be able to prove that they have completed the relevant course for issuing a certificate and are therefore entitled to issue this certificate.
